Media Report Analysis
The media report I used was from 12 January 2010, 'Opes Prime directors face criminal action' by Matthew
http://www.ukthesis.org/dissertation_sample/New_Zealand_Dissertaion_Sample/Drummond found in The Australian Financial Review. It is about how the directors of Opes Prime, the stockbroker
whose 2008 collapse revealed risk management failures at a major bank and a stash of Maseratis, are facing
potential jail terms.
(a) Identify aspects of the media report that relate to the law (For example this may include criminal law, tort
law, contract law, property law, administrative law or corporations law). Be sure to explain specifically how
and why you come to this conclusion.
The newspaper report deals with the following areas of law:
1. Corporations
2. Contract
3. Property and
4. Criminal law
5. Stockbrokers
For example, because Opes Prime is a company with directors and creditors the report therefore deals with
Corporations Law issues. Another example of law that the report deals with is criminal law. The report says that "If
convicted they face a maximum penalty of five years jail".
The report also deals with areas of contract and property law. For example Opes Prime had a contract in the form
of a $95million loan agreement with ANZ just before the collapse. In return the the ANZ had property rights over
the company.
